Supreme court rebuked Congress for being so late in raising the issue.

Hearing the plea on Thursday, the three-judge bench of Justices Dipak Misra, Amitav Roy and A M Khanwilkar questioned the petitioner over the delay in raising the issue. “why are you so late in raising the question as EC issued notification in Jan 2014?,”

Various parties,different organisations have organised a strike in Tamil Nadu on Friday to protest against attacks on Tamils and their property in Karnataka.
This strike caused problems for public as Majority of the shops, private schools, transport services like auto-rickshaws, private buses, fuel outlets did not function on Friday owing to the shutdown.
Top opposition leaders MK Stalin and Kanimozhi of the DMK, and MDMK’s Vaiko have ben taken arrested by the Police. Impact of the bandh is visible in the neighbouring state Puducherry.
MDMK Chief Vaiko has also been detained in Tiruchirappalli during protest.

Kaveri water dispute is a very old problem. Both states blame that they are not receiving their appropriate share of water. The problem started when Princely State of Mysore and Madras Presidency signed two agreements in 1892 and 1924. But both states very unhappy as they felt they are not receiving their due share of waters from the river due to biased treaty.
To sort out the issue The Government of India constituted a panel in 1990. After 16 years the tribunal delivered it’s order on 5 February 2007.
n its verdict, the tribunal allocated 419 TMC of water annually to Tamil Nadu and 270 TMC to Karnataka; 30 TMC of Kaveri river water to Kerala and 7 TMC to Puducherry. Karnataka and Tamil Nadu being the major shareholders, Karnataka was ordered to release 192 TMC of water to Tamil Nadu in a normal year from June to May.
Politically Kaveri water issue is a very sensitive issue in both states as millions of farmers in both states depends on water of Kaveri river for irrigation.
After independence Kerala and Puducherry also demanded their share of water from Cauvery.

SFI leader says Left and Congress is playing with student’s future in Rohith Vemulla

According to a news report published in Times of India,Raju Kumar Sahu,General Secretary of SFI, is not happy the way congress and left is using students to achieve their political goal.

Sahu is also worried that due to the ‘opportunistic’ political games of Congress and Left parties students’ future seems to be in dark as it this episode is affecting their placements as students are not able to focus on their studies.

This is this reason Raju Kumar Sahu has decided to resign from SFI. Raju Kumar Sahu was the general secretary of the SFI.

SFI is the student wing of the CPI(M). Sahu has leveled serious allegations on SFI and Congress both.

Sahu alleged that the movement is funded by the Congress, Left and other opportunistic forces.

The TOI quoted from Sahu’s letter: “My loneliness and alienation are affecting my studies and also apparently driving me towards the unfortunate path undertaken by Rohith. I think coming into the open and getting distanced from the wrong way would save me from the doom (sic).”

Sahu added that the real losers in the entire ‘game’ are the common students who have suffered in terms of placements.

 

Teesta Setalvad’s NGO file missing: Home ministry official was arrested by CBI

The CBI has arrested a Home ministry official for corruption charges and keeping a file with him in illegal manner for three months. The file was related to Teesta Setalvad’s NGO Sabrang .

Government Of India suspended the registration of Sabrang in September 2015 under the Foreign Contributions Regulation Act (FCRA). The MHA officials could not find the file related to Sabrang NGO and they contacted CBI to investigate the matter further.

Home ministry officials hinted that government is taking this act very seriously and serious actions cannot be ruled out against the official.

CBI also recovered Rs 7.5 lakhs and other documents, files containing sensitive information related to MHA and I&B ministries.

Intelligence agencies is investigating if these files and papers were shared with outsiders and if yes with whom?

Rahul Gandhi was scheduled to address an election rally at Karaikal in Puducherry.

Rahul provided this information at Twitter.

“Unfortunately I have been down with high fever since Sunday and the doctor has advised rest for the next two days,” the 45-year-old Congress leader said on micro-blogging site Twitter late Monday night.

“My apologies to the ppl of Puducherry, Tamil Nadu & Kerala for missing this opportunity of being with them on 10th &11th May as planned.

“Shall keep everyone updated about the rescheduled visits,” Rahul said in his tweets.

Despite Centre’s assurance to provide adequate security to Rahul Gandhi this decision was taken.

Top Congress leaders met Unioin Home Minister on Monday after AICC general Secretary Narayanasamy received an “unsigned letter” threatening to attack him and Rahul.

The Special Protection Group and the Intelligence Bureau were on Monday ordered by the government to take maximum precautions for Rahul Gandhi’s security in the wake of the threat letter.

Rahul Gandhi was in Tamil Nadu on last Saturday (07/05/2016) and addressed rallies in Madurai, Coimbatore and Maduravoyal with DMK’s MK Stalin.

 

Crony wealth is just 3% of GDP in Modi raj while it was 18% in UPA regime.

According to The Economist’s index of crony capitalism study there is sharp decline in Crony capitalism in India. Crony capitalism was 18 percent of GDP in 2008 but currently it is just 3% of GDP.

“Encouragingly, India seems to be cleaning up its act. In 2008 crony wealth reached 18 percent of its GDP, putting it on a par with Russia. Today it stands at 3 percent of its GDP, a level similar to Australia,” the study revealed.

According to the study Russia is the worst crony-capitalist country and Germany is the cleanest country.

Russia has been ranked the worst crony-capitalist country, followed by Malaysia, Philippines, Singapore, Ukraine, Mexico, Indonesia and Turkey above India. India has been ranked 9th followed by Taiwan and China that are ranked 10th and 11th.

The magazine’s index of crony capitalists is based on a study by Ruchir Sharma of Morgan Stanley Investment Management and Aditi Gandhi and Michael Walton of Delhi’s Centre for Policy Research.

 

Mumbai court drops charges against 9 accused due to lack of evidence in Malegaon blast case.

A Mumbai court has accepted the discharge applications of nine accused in Malegaon bomb blast case and ordered the release of the accused. Atleast 37 people were killed in the Malegaon blast in 2006.The court headed by Session Judge VV Patil has also ordered to drop charges against the nine accused.

Till now two accused have been convicted in this case and six were released.

“It is submitted that evidence collected by NIA in further investigation is not in consonance with evidence collected by the Anti-Terrorism Squad and the CBI. The court may kindly pass appropriate orders in the matter,” the anti-terror agency told a special NIA court in response to discharge applications filed by the nine accused.

The 2006 bombings were part of a series of explosions that had rocked Malegaon, a communally sensitive power-loom town in Nashik district of Maharashtra, located about 300 km from Mumbai.

 

Government has finalized list of 6 nominees for Rajya Sabha as per reports

According to reports from various sources, The Bhartiya Janta Party is going to nominate Navjot Singh Siddhu, Subramanian Swamy, Swapan Dasgupta,MC Mary Kom and Suresh Gopi and Narendra Jadhav for Rajya Sabha.
The Rajya Sabha or Council of States is the upper house of the Parliament of India.Total strength of the Rajya Sabha is 245.Members are elected indirectly by state and territorial legislatures.
The BJP has 48 members in the upper house while the Congress has 66.
At present the Congress has 67 members, the BJP 48, the Samajwadi Party 15, the AIADMK, the Trinamool Congress and the JD(U) 12 each, the BSP 10 and the CPI(M) 9.
74 Rajya Sabha members are retiring in 2016 including union ministers Nirmala Sitharaman ,M Venkaiah Naidu,Piyush Goyal and Mukhtar Abbas Naqvi.
Government can appoint 12 members.

TERI shows exit door to RK Pachauri after multiple sexual harassment allegations

The Energy and Resources Institute (TERI) removed RK Pachauri from its governing council and organization. This decision was taken in a meeting held on Monday. Governing council chairman Mr. Ashok Chawla was heading the meeting.

Mr Pachauri was not present in the meeting as he was travelling abroad. Indeed Mr. Pachauri was not invited in the governing council meeting as his membership ended on March 31.

TERI also decided not to renew the membership of Mr. Pachauri. Though information has not been updated on TERI website regrading this. TERI website still says “Dr Rajendra K Pachauri is the Executive Vice Chairman (on leave) of the Governing “.

Mr Pachauri joined TERI as director in 1982. In April 2002 he was elected as Chairman of the Intergovernmental Panel on Climate Change (IPCC) and was reelected in September 2008.IPCC along with former Vice President of US Al Gore was awarded the Nobel Peace Prize for the year 2007.

 

NIA officer Tanzil Ahmed murder: UP police arrested Jainul and Reyaan while main accused Muneer is still out of reach

Uttar Pradesh Police got major success in Tanzil Ahmed murder case. UP police has arrested two men Jainul and Reyaan.

Police questioned 100 people and conducted raids at several places to arrest these two criminals.

Main accused Muneer is still out of police reach and police has declared a reward of Rs 50,000 on Muneer.

Tanzil Ahmed, probing terror cases related to Indian Mujahideen, was shot dead on April 3 by two motorcycle-borne assailants who also wounded his wife when they were returning home from a wedding near Bijnor district.

One more setback: JNU student leader Kanhaiya Kumar was sent in Police custody for 15 days

JNU Student Union president Kanhaiya Kumar was sent in Police custody for 15 more days after The Delhi High Court adjourned his bail plea hearing for February 29.

The Delhi High Court accepted argument provided by Aditional solicitor general Tushar Mehta and rejected Kanhaiya Kumar’s request.

“After yesterday’s development, two of the accused have surrendered and are in safe custody. Their remand is yet to be taken. In the backdrop of the new development and as per our statutory right of 15 days police custody of an accused, we will be seeking remand of Kanhaiya Kumar to confront him with Umar Khalid and Anirban Bhattacharya,” said Aditional solicitor general Tushar Mehta.

Senior advocate Kapil Sibal was representing Kanhaiya Kumar. Kapil Sibal said Kanhaiya Kumar should be granted bail  since there is no evidence against Kanhaiya Kumar as per the status report filed by Delhi Police.

Contrary to previous trends Prime Minister Narendra Modi has declined to receive an honorary doctorate from Banaras Hindu University. Modi is not in favour of personal glorification and in past he declined such offers in past also.

BHU, in a statement, had said it proposed to confer Doctor of Laws (LLD) (honoris causa) on Modi in recognition of his “yeoman services as an innovator, reformer and an outstanding leader in public service and governance”.

Prime Minister Narendra Modi is visiting Modi will be visiting BHU on February 22 to attend its convocation.

Former Prime minister Dr. Manmohan Singh received honorary degrees from various national and international Universities. Former Prime Minister Dr. Manmohan Singh received Honorary Doctor of Law degree from the University of Alberta in 1997.The University of Oxford, Benaras Hindu University,University of Madras,King Saud University  and the University of Cambridge also awarded such degrees to him.

The Supreme Court of India today paved the way for a new government in the Arunachal Pradesh.

The Supreme Court today vacated its earlier order staying the revocation of President’s rule in Arunachal Pradesh.

The Supreme Court upheld the verdict given by the Gauhati high Court reading the disqualification of 14 Congress MLAs. This is a major setback for the Congress Party who was fighting the case against NDA government.

The Supreme Court said “Prima facie we are convinced that the MLAs were disqualified without being served notice,”

The Apex Court has rejected all arguments provided by Congress representative Kapil Sibal and FS Nariman.

Union Minister Ram Vilas Paswan demands reservation in private sector

According to a news report by PTI, Union Minister of Food and Public Distribution Ram Vilas Paswan demanded reservation for the backward classes in the private sector jobs. According to Paswan this will improve the condition of Dalits in the country.

Ram Vilas Paswan was speaking to reporters in Kolkata after attending a party programme.

“We demand that there should be a law which enables there should be reservation for backward classes, SCs and STs in the private sector jobs too. We see that even after so many years of independence the condition of Dalits in the country is still very bad,”- Ram Vilas Paswan

Reservation in Private sector is not a new demand. The UP government introduced voluntary reservation for backward classes in the private sector in 2007.As per this policy private firms that introduce 30 per cent reservation in their establishments will be provided tax benefits.

An 11 year-old boy shared his Man Ki Baat to the PM Narendra Modi mentioning the problem faced by him due to absence of a crossing at the railways tracks between his locality and the school. Due to the absence of Crossing he had to take a longer route to reach his school daily. People from his locality is also facing the same story. Apart from this regular accidents happening at this place.

”Accidents keep happening near the railway track. We face problems while going to school in absence of crossing,” he said.

Supreme Court reprimanded States for not implementing Acts passed by Parliament

The Supreme Court castigated some states for not implementing law passed by Parliament of India. The Supreme Court slammed Gujrat for not implementing Food Security Act that was passed by Parliament.
“What is Parliament doing? Is Gujarat not a part of India? The Act says it extends to whole of India and Gujarat is not implementing it. Tomorrow somebody can say that it is not going to implement the CrPC, IPC and the Evidence Act,” a bench headed by Justice Madan B Lokur said.

“Does Gujarat want to breakaway from India? How can a state say that it won’t follow law passed by Parliament,” the SC said.

The bench asked the Centre to provide the status of welfare schemes like MGNREGA, National Food Security and mid-day meal from drought-hit states.

The bench was hearing a PIL which alleged that parts of states like Uttar Pradesh, Karnataka, Madhya Pradesh, Andhra Pradesh, Telangana, Maharashtra, Gujarat, Odisha, Jharkhand, Bihar, Haryana and Chattisgarh have been hit by drought and the authorities were not providing adequate relief.

The PIL was filed by NGO Swaraj Abhiyan.

A Kolkata court pronounced the sentences in sensational and brutal Kamduni gangrape case.

A Kolkata court handed capital punishment to Aminul Ali, Saiful Ali and Ansar Ali while  Imanul Islam and  Aminul Islam were sentenced to life imprisonment for the gangrape and brutal murder of the woman on June 7, 2013.

Saiful Ali, Ansar Ali and Aminul Ali were found guilty under sections 376(d) (gangrape), 302 (murder), 376A (inflicting injury which causes death of a woman) and 120B (criminal conspiracy) of IPC.

Two accused – Rafiqul Islam and Nur Ali were acquitted due to lack of evidence.

Another accused Gopal Naskar died during trial in August last year.

Ansar Ali one of the accused threaten the relatives of the victim.

The gang-rape and brutal murder of the 21-year-old college girl occurred when she was returning home at Kamduni, about 50km from Kolkata, in North 24-Parganas district after appearing for an examination at her college on June 7, 2013.

The second year BA student was pulled into a farm when she was walking back home along a deserted road after alighting from a bus.

She was gang-raped and gruesomely murdered subsequently

The Bharatiya Muslim Mahila Andolan (BMMA) has filed a petition in  the Bombay high court seeking a ruling that the ban is unconstitutional.

According to the the Haji Ali Dargah trust it was a “grievous sin” as per Islam for women to be in close proximity of the grave of a male Muslim saint.

Defense Ministry recommended CBI Inquiry against two top serving Generals of the Indian Army.
CBI will probe corruption charges against two top serving Generals of the Indian Army on allegations of disproportionate income and paying bribe for their promotions. These two Army officers are Major General Ashok Kumar, General Officer Commanding Kolkata sub area, and Major General SS Lamba, posted in Delhi as additional director general Ordnance.

While Kumar is from the Army Service Corps, Lamba belongs to the Army Ordnance Corps.

CBI will probe the allegation that the officers amassed wealth beyond their known sources of income.

According to India Today report both officers are decorated officers. Kumar was awarded the Ati Vishisht Seva Medal and Lamba was a recipient of Sena medal last year.

Both officers were being monitored from for quite some at the level of the PMO and after getting primary evidence CBI Probe ordered against them

“Corruption charges against the officers were being monitored for quite some time even at the level of the Prime Minister’s Office (PMO). It is only after due consideration that the CBI was involved by the defence minister Manohar Parrikar,” said a source.

Supreme Court scolded bluntly Congress for not paying requisite court fee in full and using incorrect fonts in the petition filed by the Party to challenging the decision of imposing President Rule in Arunchal Pradesh.

However, Justice Khehar reprimanded Congress for not paying the requisite court fee in full while filing the petition. There was a shortfall of Rs. 800 in the court fee paid to the Supreme Court Registry.

Justice Khehar said there were a lot of other “defects” in the petiton filed by Bamang Felix, Chief Whip of the Congress Legislative Party of Arunachal Pradesh.

The Congress party side saw a whole array of top lawyers present in court, including senior advocates Fali Nariman, Kapil Sibal and Vivek Tankha.

Justice Khehar said “the Registry has raised a lot of objections. You have paid less court fee. You have to pay Rs. 800 more…”

Justice Khehar further said “ Children are just saying… please look into this… when you file urgent matters like this, ensure that you pay court fee in full”.

 

Congress Party challenged the constitutionality of the Union Cabinet recommendation and subsequent imposition of President’s Rule in Arunachal Pradesh ruled by the Congress party.

Supreme Court accepted the petition and forwarded it to a five-judge Constitution Bench.

Supreme Court asked Centre to respond by Friday.

These claims have been made by military historian General GD Bakshi in his yet-to be-published book – Bose: An Indian Samurai.

Clement Atlee  was the Prime Minister of the United Kingdom from 1945 to 1951 and had signed the decision to grant independence to India.

Bakshi has reportedly cited a conversation between Atlee and then Governor of West Bengal Justice PB Chakraborty in 1956.

This claim is based on a conversation between Atlee and then Governor of West Bengal Justice PB Chakraborty in 1956. Chakraborty was the then Chief Justice of the Calcutta High Court and was serving as the acting Governor of West Bengal.

As per the report, he had written a letter to the publisher of RC Majumdar’s book – A History of Bengal.

The website quotes him as follows – “When I was acting governor, Lord Attlee, who had given us independence by withdrawing British rule from India, spent two days in the governor’s palace at Calcutta during his tour of India. At that time I had a prolonged discussion with him regarding the real factors that had led the British to quit India. My direct question to Attlee was that since Gandhi’s Quit India Movement had tapered off quite some time ago and in 1947 no such new compelling situation had arisen that would necessitate a hasty British departure, why did they had to leave? In his reply Attlee cited several reasons, the main among them being the erosion of loyalty to the British crown among the Indian Army and Navy personnel as a result of the military activities of Netaji.”

He is further quoted as thus – “Toward the end of our discussion I asked Attlee what was the extent of Gandhi’s influence upon the British decision to leave India. Hearing this question, Attlee’s lips became twisted in a sarcastic smile as he slowly chewed out the word, ‘m-i-n-i-m-a-l’.”

The above conversation was first published by the Institute of Historical Review by author Ranjan Borra in 1982.
